Bagaria Tours and Safaris Ltd
Effective Date: 13 August 2026
Last Updated: 13 August 2026
These Booking Terms & Conditions (“Terms”) apply to safari, tour, accommodation, transport, excursion, flight and other travel arrangements booked with Bagaria Tours and Safaris Ltd (“Bagaria Tours”, “we”, “us”, or “our”).
By submitting a booking request, paying a deposit or other amount towards a booking, or otherwise confirming acceptance of a quotation or itinerary, the client acknowledges that they have read, understood and agreed to these Terms.
A booking contract is created between Bagaria Tours and Safaris Ltd and the person making the booking when:
Bagaria Tours confirms the booking in writing; and
the required deposit or other agreed payment has been received.
The person making the booking (“Lead Traveller”) confirms that they:
are at least 18 years old;
have authority to make the booking;
have authority to accept these Terms on behalf of all travellers included in the booking; and
will ensure that all travellers are made aware of these Terms.
The Lead Traveller is responsible for providing complete and accurate information about all persons included in the booking.
The confirmed quotation, itinerary, invoice, booking confirmation and these Terms together form the basis of the booking agreement.
Where a specific written quotation or booking confirmation contains special terms that differ from these general Terms, the specific written terms communicated for that booking shall apply to the extent of the difference.
Unless otherwise stated, quotations are subject to availability and are not guaranteed until a booking is confirmed.
Safari prices may be based on factors including:
accommodation availability;
park and conservancy fees;
government taxes;
transport costs;
airline fares;
fuel costs;
exchange rates;
number and age of travellers;
rooming arrangements;
travel season.
A quotation does not guarantee availability of accommodation, flights or other services until those services have been reserved and confirmed.
Where a quoted property becomes unavailable before confirmation, Bagaria Tours may offer a comparable alternative and advise the client of any resulting price difference.
Unless otherwise specified in the quotation, a minimum deposit of 20% of the total booking cost is required to confirm a booking.
Some accommodation providers, airlines, charter operators or other suppliers may require:
a higher deposit;
a non-refundable deposit; or
full payment at the time of booking.
Where such conditions apply, Bagaria Tours will communicate them to the client.
A booking shall not be considered fully confirmed until Bagaria Tours has received the required payment and issued written confirmation.
The client should carefully review the booking confirmation and immediately notify Bagaria Tours of any errors.
Unless otherwise stated in writing, the outstanding booking balance must be paid no later than 45 days before the safari or tour start date.
Certain camps, lodges, airlines, charter operators and other suppliers may require final payment 50 to 60 days or more before travel.
Where a supplier requires earlier payment, the applicable deadline will be communicated to the client and shall form part of the booking conditions.
For bookings made within 45 days of departure, full payment may be required at the time of confirmation.
If payment is not received by the applicable deadline, Bagaria Tours may treat the booking as cancelled by the client.
Applicable cancellation charges may then apply.
Bagaria Tours may accept payment through approved methods including:
bank transfer;
credit card;
debit card; and
other payment methods specifically approved by Bagaria Tours.
Payment instructions will be provided on the relevant invoice or through an authorised payment channel.
International safari quotations are normally payable in United States Dollars (USD) unless another currency is expressly stated on the invoice.
Kenyan resident or domestic bookings may be quoted and paid in Kenya Shillings where agreed.
The client is responsible for bank charges, intermediary bank fees and other transfer costs.
The full invoiced amount must reach Bagaria Tours’ nominated account.
Credit or debit card payments may attract a payment-processing charge of up to 3%, where applicable and disclosed before payment.
Payments shall only be made to bank accounts, payment links or other channels officially communicated by Bagaria Tours.
Clients should contact Bagaria Tours directly where there is any doubt concerning payment instructions.
Bagaria Tours takes reasonable care when preparing quotations and invoices.
If an obvious pricing, calculation or typographical error is identified before full performance of the booking, Bagaria Tours will notify the client as soon as reasonably possible.
The client may be given the option to:
proceed at the corrected price; or
cancel the affected service and receive a refund of amounts recoverable for that affected service.
Bagaria Tours will not knowingly rely on an obvious pricing error to mislead a client.
Cancellation requests must be made in writing by the Lead Traveller or authorised booking agent.
The cancellation date will be the date on which Bagaria Tours receives the written cancellation.
Unless stricter supplier conditions apply, the following cancellation charges apply:
| Cancellation Period | Cancellation Charge |
|---|---|
| 60 days or more before departure | 20% of total booking cost |
| 45–59 days before departure | 50% of total booking cost |
| 30–44 days before departure | 80% of total booking cost |
| 0–29 days before departure | 100% of total booking cost |
| No-show | 100% of total booking cost |
Where the amount already paid is lower than the applicable cancellation charge, the client may remain responsible for the difference, subject to applicable law and supplier obligations.
Where the amount already paid exceeds the applicable cancellation charge, any refundable balance will be returned after deduction of:
applicable cancellation charges;
non-refundable supplier payments;
bank charges;
card processing costs that cannot be recovered; and
other legitimately non-recoverable booking costs.
Certain services may carry stricter cancellation conditions than Bagaria Tours’ standard policy.
Examples may include:
luxury camps and lodges;
exclusive-use properties;
peak-season accommodation;
charter flights;
scheduled domestic or international flights;
rail tickets;
gorilla or chimpanzee permits;
park permits;
special activities;
private conservancy reservations.
Where Bagaria Tours informs the client of supplier-specific cancellation conditions, those conditions will apply to the relevant portion of the booking.
Where possible, such conditions will be communicated before confirmation.
Certain services may become partially or fully non-refundable once confirmed or paid.
These may include:
airline tickets;
charter flights;
permits;
park or conservation fees;
special event tickets;
certain accommodation deposits;
third-party reservation fees;
customised services purchased specifically for the client.
Bagaria Tours will make reasonable efforts to identify material non-refundable items before or at the time they become binding.
Requests to change a confirmed booking must be submitted in writing.
Bagaria Tours will make reasonable efforts to accommodate requested changes but cannot guarantee that they will be possible.
The client will be responsible for:
additional supplier charges;
cancellation charges;
fare differences;
administration costs where applicable; and
any increase in the total cost resulting from the requested change.
Changing travel dates may be treated as cancellation and rebooking where suppliers do not permit amendments.
Where Bagaria Tours and the client agree to postpone a trip instead of cancelling it, the terms of postponement will be confirmed in writing.
Any credit issued may be subject to:
a specified validity period;
seasonal supplements;
supplier availability;
rate increases;
changes in park fees or taxes;
airline fare differences;
supplier-specific restrictions.
A postponement or travel credit is not automatically equivalent to a cash refund unless expressly agreed.
Safari travel may sometimes require itinerary changes.
Bagaria Tours reserves the right to make reasonable changes where required because of:
weather;
road conditions;
park or conservancy restrictions;
wildlife movements;
accommodation availability;
flight changes;
safety concerns;
government requirements;
border restrictions;
supplier operational issues;
circumstances beyond our reasonable control.
Minor itinerary adjustments may be made where they do not materially reduce the overall value or character of the safari.
Where Bagaria Tours makes a significant change before departure, we will notify the client as soon as reasonably possible.
Depending on the circumstances, we may offer:
suitable alternative arrangements;
an alternative property or service of a reasonably comparable standard;
a revised itinerary; or
another appropriate remedy.
Where the replacement service has a lower recoverable value, an appropriate adjustment may be made where applicable.
Safari camps and lodges may occasionally become unavailable because of circumstances outside Bagaria Tours’ control.
Where this occurs, Bagaria Tours will make reasonable efforts to provide accommodation of a comparable category and location.
Where an alternative of equivalent standard is unavailable, the client will be informed of the available options and any material price difference.
Bagaria Tours shall not be responsible for failure or delay caused by extraordinary circumstances outside its reasonable control.
These may include, without limitation:
severe weather;
flooding;
drought;
wildfire;
earthquakes;
epidemics;
pandemics;
government restrictions;
border closures;
war;
civil unrest;
terrorism;
strikes;
airport closures;
airspace restrictions;
major transport disruption;
natural disasters;
acts of government;
unforeseeable failures of essential infrastructure.
Where such circumstances affect a booking, Bagaria Tours will make reasonable efforts to:
protect the client’s safety;
communicate material changes;
rearrange affected services;
obtain supplier credits or refunds where available; and
provide reasonable alternatives.
Any refund will be subject to amounts actually recoverable from suppliers and other applicable legal rights.
Additional costs arising from unavoidable circumstances may be payable by the client where those costs cannot reasonably be recovered elsewhere.
Comprehensive travel insurance is required for all international clients travelling with Bagaria Tours unless Bagaria Tours expressly agrees otherwise in writing.
Domestic travellers are also strongly advised to maintain appropriate travel insurance.
The policy should, where appropriate, cover:
emergency medical treatment;
emergency evacuation;
medical repatriation;
trip cancellation;
trip interruption;
missed connections;
travel delays;
loss or theft of personal belongings;
baggage;
personal liability;
activities included in the itinerary.
Clients should ensure that their policy adequately covers safari activities and all destinations included in their itinerary.
Bagaria Tours may request travel insurance details before departure.
The purchase of insurance remains the client’s responsibility.
Bagaria Tours welcomes travellers with different mobility and accessibility requirements and will make reasonable efforts to arrange suitable services where such requirements are disclosed in advance.
Clients should inform Bagaria Tours before booking, or as early as possible, about any condition or requirement that may materially affect travel arrangements, including:
mobility requirements;
wheelchair use;
accessible room requirements;
medical conditions relevant to travel;
allergies;
dietary requirements;
need for assistance;
other special requirements.
Disclosure enables Bagaria Tours to confirm whether appropriate:
vehicles;
rooms;
transfers;
flights;
activities;
assistance; and
facilities
can reasonably be arranged.
Bagaria Tours will not intentionally discriminate against a traveller because of disability.
However, some safari locations are remote and certain camps, vehicles, aircraft or activities may have physical or operational limitations outside our control.
Where a requested service cannot reasonably accommodate a particular requirement, we will endeavour to explain the limitation and suggest suitable alternatives where available.
Clients are responsible for ensuring they are reasonably fit to undertake their booked itinerary.
Bagaria Tours does not provide medical advice.
Clients should seek appropriate medical advice before travelling where they have concerns relating to:
existing medical conditions;
vaccinations;
medication;
altitude;
pregnancy;
mobility;
tropical diseases;
strenuous activities.
Bagaria Tours will communicate disclosed dietary requirements and allergies to relevant suppliers where reasonably possible.
Because meals are normally prepared by independent hotels, camps and lodges, Bagaria Tours cannot guarantee an entirely allergen-free environment.
Travellers with serious allergies should carry appropriate medication and discuss their requirements with both Bagaria Tours and the relevant accommodation provider.
Each traveller is responsible for ensuring they possess the documentation required for their journey.
This may include:
a valid passport;
Electronic Travel Authorisation;
visa;
vaccination certificate;
travel insurance evidence;
return or onward ticket;
parental consent documentation for minors;
other immigration documentation.
Travellers should generally ensure their passport satisfies the validity requirements of every country visited.
Bagaria Tours may provide general assistance or links concerning entry requirements, but immigration rules are determined by government authorities and may change.
Bagaria Tours will not be responsible for a traveller being denied boarding or entry because the traveller:
lacked required documentation;
provided inaccurate information;
failed to obtain a required visa or authorisation; or
did not satisfy an applicable immigration requirement,
except to the extent that the loss was directly caused by Bagaria Tours’ own proven error.
Flights may be provided by independent airlines or charter operators.
Airlines may change:
schedules;
aircraft;
baggage allowances;
departure points;
routing;
operating conditions.
Bagaria Tours will make reasonable efforts to communicate known changes affecting a client’s itinerary.
Any airline ticket remains subject to the airline’s conditions of carriage and fare rules.
Clients must comply with baggage limitations imposed by airlines, charter aircraft and transport providers.
Safari aircraft in particular may impose restrictions concerning:
total baggage weight;
dimensions;
hard-shell suitcases;
soft-sided luggage.
Specific baggage requirements will be communicated where they apply to the client’s itinerary.
Charges resulting from excess baggage remain the traveller’s responsibility unless otherwise agreed.
Wild animals move freely within parks, reserves and conservancies.
Bagaria Tours therefore cannot guarantee sightings of any particular animal, species, migration event, river crossing or wildlife interaction.
Guides will use their professional knowledge and reasonable efforts to provide the best possible safari experience.
References to wildlife sightings or seasonal events in itineraries, advertisements or website materials describe expected possibilities and are not guarantees.
Natural events such as the Great Migration, river crossings, calving seasons, flamingo concentrations and other wildlife movements depend on environmental and ecological conditions.
Timing and location may vary from year to year.
Bagaria Tours cannot guarantee that such an event will occur at a particular date, time or location.
Clients are expected to behave responsibly and respectfully towards:
guides;
drivers;
staff;
other travellers;
local communities;
wildlife;
accommodation personnel.
Clients must follow reasonable safety instructions given by guides, park authorities, accommodation providers and other authorised personnel.
Bagaria Tours may terminate a client’s participation where their conduct:
creates a serious safety risk;
threatens wildlife;
is unlawful;
seriously disrupts the safari;
threatens or abuses staff or other travellers; or
causes substantial damage to property.
Where participation is terminated for serious misconduct, refunds may not be available for unused services.
Safari travel involves inherent risks, including travel:
near wild animals;
on unpaved or rough roads;
in remote areas;
in boats;
in small aircraft;
in wilderness environments.
Clients must follow safety instructions and must not:
leave vehicles where prohibited;
approach or feed wildlife;
ignore guide instructions;
enter restricted areas.
Participation in optional adventure activities may also be subject to separate safety requirements or waivers issued by the activity provider.
Bagaria Tours arranges and coordinates services that may be provided by independent third parties including:
hotels;
camps;
lodges;
airlines;
charter companies;
rail operators;
transport companies;
activity providers;
guides;
conservation organisations;
park authorities.
These providers remain responsible for operating their respective services in accordance with applicable law and their contractual obligations.
Bagaria Tours remains responsible for its own contractual obligations and cannot exclude liability where such liability cannot lawfully be excluded.
Bagaria Tours will exercise reasonable skill and care when arranging the services forming part of the client’s confirmed itinerary.
Nothing in these Terms is intended to exclude or limit any right or liability that cannot legally be excluded under Kenyan law.
Subject to applicable law, Bagaria Tours shall not be responsible for loss arising solely from:
acts or omissions of the client;
unforeseeable acts of unrelated third parties;
circumstances outside Bagaria Tours’ reasonable control;
failure by the client to follow reasonable safety instructions;
loss or damage to personal belongings not caused by Bagaria Tours’ negligence;
immigration refusal caused by the client’s documentation;
independent changes made by airlines or other suppliers where Bagaria Tours did not cause the change.
Clients remain responsible for safeguarding:
passports;
cash;
jewellery;
electronic devices;
luggage;
cameras;
personal documents;
other valuables.
Where safes or secure storage facilities are available, clients are encouraged to use them.
Losses should be reported promptly to the relevant accommodation provider, guide, police or other appropriate authority where necessary for an insurance claim.
Clients carrying professional or high-value equipment are responsible for:
appropriate insurance;
safe storage;
airline baggage compliance;
customs requirements;
permits where applicable.
Bagaria Tours is not responsible for loss or damage to photographic, electronic or other personal equipment except where liability arises under applicable law.
Activities not included in the confirmed itinerary are undertaken at the client’s discretion.
Optional activities may be operated by independent providers and may be subject to:
additional charges;
separate terms;
age restrictions;
health requirements;
weight limits;
safety requirements;
separate waivers.
Examples may include:
hot-air balloon safaris;
rafting;
diving;
water sports;
trekking;
horse riding;
cycling;
walking safaris.
No refund will normally be given for services voluntarily missed or unused by the client after the safari has commenced, including:
accommodation;
meals;
game drives;
transfers;
excursions;
flights;
activities,
unless the failure to provide the service results from Bagaria Tours or a refund is otherwise required by applicable law.
Clients are responsible for arriving at agreed departure points at the required time.
Where a traveller misses a service because of:
late arrival;
missed international flight;
immigration delay;
personal scheduling error;
other circumstances not caused by Bagaria Tours,
the client may be responsible for additional costs required to rejoin the itinerary.
Travel insurance may provide cover depending on the circumstances and policy terms.
If a client experiences a problem during the safari, they should report it as soon as reasonably possible to:
the safari guide or driver;
the relevant hotel, camp or service provider where appropriate; and/or
Bagaria Tours’ office.
Reporting an issue promptly gives us an opportunity to investigate and, where possible, resolve it while the client is travelling.
Where a matter remains unresolved, the client should submit a written complaint to Bagaria Tours within 14 days after completion of the trip, where reasonably possible.
The complaint should include:
booking reference;
travel dates;
description of the issue;
relevant photographs or documentation where applicable;
steps already taken to report the issue.
Failure to complain within 14 days does not remove any legal right that cannot lawfully be excluded, but delayed reporting may make investigation substantially more difficult.
Bagaria Tours processes personal information in accordance with applicable Kenyan data protection law and its published Privacy Policy.
Client information may be shared where reasonably necessary with suppliers involved in delivering the booking, including:
accommodation providers;
airlines;
transport providers;
guides;
activity providers;
immigration or government authorities where required.
Some bookings involve cross-border travel and may require personal data to be transferred outside Kenya.
Further information is provided in the Bagaria Tours Privacy Policy available on our website.
Bagaria Tours will not intentionally use a clearly identifiable client’s photograph or video for commercial marketing where consent is required without obtaining the appropriate permission.
Clients who do not wish to appear in promotional photography should notify Bagaria Tours or the photographer.
Unless otherwise stated, content produced by Bagaria Tours, including:
written itineraries;
website content;
photographs owned by Bagaria;
graphics;
branding;
tour descriptions;
marketing materials
remains the intellectual property of Bagaria Tours or its respective licensors.
Clients may use personal travel documents for purposes connected with their booking but may not commercially reproduce Bagaria’s proprietary content without permission.
Bagaria Tours makes reasonable efforts to maintain accurate information on its website.
However:
accommodation facilities may change;
park fees may change;
government requirements may change;
seasonal conditions vary;
photographs are illustrative;
wildlife sightings cannot be guaranteed.
The client’s confirmed quotation and itinerary take precedence over general website descriptions where there is a difference relating to a specific booking.
These Terms and any booking contract with Bagaria Tours and Safaris Ltd shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.
Nothing in these Terms removes any consumer rights that apply under Kenyan law and cannot legally be waived.
If a dispute arises, the parties shall first make reasonable efforts to resolve the matter through direct, good-faith discussions.
A party raising a dispute should provide written details of the complaint and the remedy sought.
Where the matter cannot be resolved through direct discussions, the parties may agree to attempt mediation in Kenya before commencing formal proceedings.
Subject to any statutory consumer rights and any matter that cannot lawfully be referred to arbitration, a dispute that remains unresolved may be referred to arbitration by written agreement in accordance with the Arbitration Act of Kenya.
The arbitration shall:
take place in Nairobi, Kenya unless otherwise agreed;
be conducted in English;
be conducted by a single arbitrator unless the parties agree otherwise.
Where the parties cannot agree upon an arbitrator, appointment may be made in accordance with the applicable Kenyan arbitration law.
Nothing in this dispute-resolution clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction or exercising a statutory right that cannot legally be restricted.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be interpreted or limited to the extent necessary to make it lawful where possible.
The remaining provisions shall continue in effect.
Failure by Bagaria Tours to enforce a provision of these Terms on one occasion does not automatically constitute a waiver of that provision or of the right to enforce it in the future.
Bagaria Tours may update these Terms periodically.
Changes will not retrospectively alter a confirmed booking unless:
required by law;
agreed with the client; or
necessary to reflect a lawful change affecting the booking.
The version applicable to a booking will normally be the version provided or available when the booking is confirmed, together with any subsequently agreed written amendments.
